Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Musicalis (“the Service”), operated by Musicalis (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Musicalis is a web-based platform that allows Catholic music directors, cantors, and accompanists to create, organize, and share music plans for liturgical celebrations. Features include hymn library management, PDF generation, plan sharing, and musician coordination.

2. Eligibility

You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. User Content

You retain ownership of any content you upload to the Service, including hymn scores and PDF files (“User Content”). By uploading User Content, you grant us a limited, non-exclusive license to store and process it solely for the purpose of providing the Service. You represent that you have the rights necessary to upload such content and that doing so does not infringe any third-party rights.

You are solely responsible for ensuring you have the appropriate licenses or permissions for any copyrighted music, sheet music, or other materials you upload to the Service.

We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, please review our DMCA Policy for instructions on submitting a takedown notice.

5. Acceptable Use

You agree not to use the Service to:

  • Upload or distribute content that infringes third-party intellectual property rights.
  • Violate any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Transmit malware, viruses, or other harmful code.
  • Harass, abuse, or harm other users.
  • Use automated means (bots, scrapers) to access the Service without our permission.

6. Subscriptions and Payments

Some features of the Service require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis. We reserve the right to change pricing with at least 30 days’ prior notice. You may cancel your subscription at any time; access will continue until the end of the current billing period.

Refunds. If you are located in the European Union or another jurisdiction that provides a statutory right of withdrawal, you may request a full refund within 14 days of your initial purchase by contacting us at info@musicalis.org. By actively using the Service before the 14-day period expires, you acknowledge that you waive this right. Outside of statutory rights, subscription fees are non-refundable.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process personal information to provide and improve the Service. By using the Service, you consent to such processing.

8. Intellectual Property

The Service and its original content, features, and functionality — excluding User Content — are and remain the exclusive property of Musicalis and its licensors. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may request account deletion at any time by contacting us at info@musicalis.org. Upon termination, your right to use the Service ceases immediately.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MUSICALIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
